These General Terms and Conditions regulate all legal relations between MoreMunich GmbH (hereinafter: MoreMunich) and their clients. They replace all former General Terms and Conditions and apply exclusively for clients. Other General Terms and Conditions are explicitly contradicted.
The contract only materializes with MoreMunich's sending a confirmation email. There is no obligation to enter into contracts.
MoreMunich only accepts booking requests via the own website, with requests having to include the full name, the number of passengers and number, size, weight and kind of pieces of luggage already at the time of request. MoreMunich reserves the right to refuse booking requests because of the number of passengers or the size, the weight or the kind of luggage.
MoreMunich is entitled to cancel the order even after confirmation if the number of passengers and/or the number, the size, the weight or the kind of luggage is significantly higher than agreed.
This right of cancellation also applies if child seats become necessary for some of the passengers but the client did not communicate this at the time of the booking request.
Also, MoreMunich is entitled to cancel the order after confirmation if the passengers and/or their luggage are not completely present at the pick-up location after more than 15 minutes past the agreed time.
For airport pick-ups, MoreMunich is entitled to cancel after 60 minutes of waiting in vain. Flight delays do not change the right of cancellation.
Also, MoreMunich is entitled to cancel the order after confirmation if the passengers and/or the luggage pose a danger to the driver, the vehicle, traffic or third parties. This right of cancellation exists especially in cases of contagious diseases, drunkenness, drug use, harmful/aggressive behaviour as well as severe insults of any kind.
In such cancellations due to circumstances within the passenger's risk area, MoreMunich is entitled to charge the agreed fee as compensation. The client is entitled to prove a lesser damage, in which case this lesser damage will be charged.
The client may cancel time bookings (hourly rental) only up to 12 hours before pick-up. For one-way transfers, 2 hours before pick-up. If the cancellation occurs later, the full agreed fee is to be paid as compensation. The client is entitled to prove a lesser damage.
The clients and the passengers are obligated to follow the driver's instructions during the ride and to refrain from any behaviour that compromises the safety of the driver, the vehicle or road traffic or the cleanliness of the vehicle. Also, the clients and the passengers are obligated to truthfully inform the driver about the contents of the luggage, so the driver can assess whether dangers to him, the vehicle or road traffic arise from it.
Payment is made via PayPal, credit card or by invoice for verified clients. Payments are only accepted in Euros.
MoreMunich will take the fastest route according to traffic conditions.
For an additional charge, intermediate stops and route deviations can be agreed upon even after booking confirmation. MoreMunich is not obligated to enter into these additional agreements and may refuse them without stating reasons.
MoreMunich is liable for slight negligence in the breach of essential contractual obligations, as well as for intent, gross negligence and damages to body, life and health. Otherwise, liability is excluded.
Statutory warranty rights for defects remain unaffected.
MoreMunich is not liable for delays due to traffic conditions.
The law of the Federal Republic of Germany applies. If the client is a consumer residing in another EU country, mandatory consumer protection provisions and mandatory consumer protection case law of the consumer's country of residence remain applicable. The UN Convention on Contracts for the International Sale of Goods is excluded. For contracts with merchants, the courts at MoreMunich's registered office have local jurisdiction. The contract language is German.
